SUING GOVERNMENT FOR COMPULSORY LAND ACQUISITION.

Court has ruled that a litigant cannot institute legal proceedings to recover land after 12 years following government acquisitions of the land.
This limitation is stipulated is provided for under Section 5 of the Limitation Act which states that no legal action shall be brought by any person to recover land after the expiration of 12 years from the date on which the right of action occurred to him/her.
This was also addressed by court in the case brought to court by Ms Joantia Nyazi the administrator of the estate of the late Semei Nyazi.
The government forcefully acquired Semei Nyanzi’s land in 1984. It is on this note that Ms Joantia Nyazi the administrator of the estate of the late Semei Nyazi petitioned the court 31 years later seeking for either/or compensation or re-possession of the land.
